1. Acceptance of Terms


By accessing or purchasing any program, service, or content offered by Optimal Edge Performance through our website or Stripe Checkout, you agree to comply with and be legally bound by these Terms and Conditions. If you do not agree, do not use our services.


2. Services Provided


We provide online fitness coaching and wellness programs, including but not limited to:

  • Structured training plans
  • Nutritional guidance
  • Coaching sessions
  • Digital downloads and tools
  • Membership tiers (e.g., Blueprint, Performance Plus, Elite)


3. Eligibility


You must be 18 years or older to use our services independently. Individuals ages 13–17 may participate with parental or guardian consent and supervision.


For Participants Under 18:

  • A parent or legal guardian must complete the checkout process.
  • By completing checkout it is assumed that guardian is aware of minor's participation.
  • Guardian assumes full responsibility for the participant’s health and safety.
  • We still reserve the right to require documentation to verify parental consent.


No one under the age of 13 is permitted to use our services.


4. Stripe Checkout and Payments


All payments are processed securely via Stripe Checkout on OptimalEdgeFit.com. By completing your purchase, you authorize Stripe to charge your selected payment method for the full program cost, including taxes or recurring charges (if applicable).


Subscriptions & Installments:

  • You agree to automatic billing at the interval shown at checkout.
  • You may cancel before your next billing cycle via your Stripe Customer Portal link.


5. Refund Policy


We offer a 30-Day Money-Back Guarantee for eligible programs.
 

To qualify:

  • Request must be made within 30 days of purchase.
  • Proof of participation is required (e.g., completed workouts or trackers).
  • Refunds are issued via Stripe to the original payment method.


Non-refundable items include:

  • Custom macros or personalized meal plans already delivered.
  • 1-on-1 coaching sessions already conducted.
  • Services or bundles marked as non-refundable at checkout.

6. User Responsibilities


You agree to:

  • Use our services legally and ethically.
  • Consult a healthcare provider before beginning any program.
  • Avoid sharing program content, which is protected by copyright law.
  • Keep your login credentials secure.


7. Intellectual Property


All content on our platform—including videos, templates, PDFs, and branding—is owned by Optimal Edge Performance. You may not:

  • Copy, reproduce, or redistribute any content.
  • Use our trademarks or branding without written permission.


8. Health Disclaimer


Our services are educational in nature. We do not provide medical advice, diagnosis, or treatment. Consult your physician before beginning any exercise or nutrition regimen.


9. Limitation of Liability


To the maximum extent permitted by law, Optimal Edge Performance is not liable for:

  • Injuries or losses related to program participation.
  • Platform outages, delays, or errors.
  • Unauthorized use of your account.


Total liability is limited to the amount paid in the 6 months prior to any claim.


10. Account Termination


We reserve the right to suspend or terminate accounts for violation of these terms, harassment, fraud, or abuse of our systems or team.


11. Privacy Policy

12. Dispute Resolution


You agree to resolve any dispute first through good faith negotiations. If unresolved, the dispute will be handled through binding arbitration in the jurisdiction of Houston, TX, under the laws of the State of Texas

We may update these Terms at any time. Continued use of our services after changes implies your acceptance of the revised terms.

Refund Policy


At Optimal Edge Performance, we are committed to providing exceptional coaching, structured programs, and strategic support. To ensure fairness and protect the integrity of our services, we maintain a clear refund policy for all digital products and coaching tiers.


General Terms

  • All digital content—including access to structured workouts via the Hevy app, instructional videos, and program materials—is non-refundable once delivered.
  • Coaching services are only eligible for a refund if the service has not been accessed, delivered, or initiated.
  • Clients are responsible for actively participating in their program. Non-use of features such as check-ins, form reviews, or messaging does not qualify for a refund.
  • Cancellations must be submitted at least 14 days prior to the next billing cycle to avoid charges for the following month.
  • Clients may request a medical or emergency service hold for up to 4 weeks with valid documentation. Holds may defer services but do not guarantee a refund.


Optimal Blueprint

4-week structured program with no ongoing coaching support

  • 100% refund available within 24 hours of purchase if no program access has been delivered via the Hevy app.
  • 50% refund available within 3 days if program access has not yet been used or opened.
  • Once the program is accessible in the app, the service is considered delivered and becomes non-refundable.
  • Any unused form review submissions may be rolled into future service if the client renews, but are not refundable. Caps at 5 credits if unused


Optimal Guidance

Includes Blueprint features plus weekly check-ins, faster messaging support, and nutrition targets

  • 100% refund available within 48 hours of purchase if no program access or coaching contact has been initiated.
  • 50% refund available within 7 days if no coaching services (check-ins, updates, or video reviews) have been delivered.
  • After 7 days or after delivery of any coaching service, the current month is considered active and becomes non-refundable.
  • Cancellation must occur before the next billing cycle to stop future charges.
  • Unused form review credits do not qualify for a refund but may roll over to the next month upon renewal. Caps at 7


Optimal Coach

High-level coaching with full customization, macro tracking, priority support, and strategic consultation

  • 100% refund available within 48 hours if no customized plan, nutrition targets, or coaching interaction has occurred.
  • Once any part of the service is delivered—custom programming, macro setup, check-in video, or form feedback—the current month becomes non-refundable.
  • Cancellation is effective the following billing cycle if submitted at least 14 days in advance.
  • Clients may request a medical or personal emergency hold of up to 4 weeks with documentation. Services will pause and resume—refunds will not be issued.


Additional Conditions

  • Emergency Holds: A one-time service hold is allowed per client contract for up to 4 weeks with valid documentation.
  • No Retroactive Refunds: If services have been delivered as described, dissatisfaction alone does not qualify for a refund.
  • Non-Engagement Clause: Failure to use available features does not make the program refundable.
  • Policy Agreement: Purchasing any service from Optimal Edge Performance constitutes agreement to these terms.
